Nigeria: Mixed Feelings Trail Imprisonment of Nollywood Actor Over Gay

Mixed feelings have continued to trail last Monday's imprisonment of a 28-year old actor, Mr. Chukwuemeka by a Karu Senior Magistrates' Court, Abuja, for having sexual intercourse with another man through the anus. While some Nigerians hailed the judgment of the court, very many others frowned at it, arguing that imprisonment of the up and coming actor was "barbaric and unacceptable to the people." According to those, who went online to express their feelings, being a homosexual should not be a crime punishable by law. Reacting to the story, one Pain of separation writes; "

  As far as I am concerned whether gay, bisexual or straight and as long as it is two consenting adults or individuals, love is love and a family is a family. I find it disheartening that this is what this country has come to. Who are we to judge a man for sleeping with another man? "Who are you to say it is wrong or right? People tend to forget that we are mere mortals and not God so the judgment of another human beings sexual orientation doesn't lie with us. We should learn to be tolerant of people with different sexual orientation and quit acting like homophobic people." In his own reaction, one Fabulous_guy writes "if the charge is not rape then I don't understand how sex between two consenting adults could be a crime! What a country of hypocrites! Two men who are adults have consentual sex and its vile and criminal and disgusting? Hypocrites." " If he raped the man in question, then he should be locked up. If it was consensual sex between two willing adults, then, they should let him go. As usual, Nigerians will conveniently call it a disgusting sin, leaving out the part that says promiscuous girls should be stoned to death and men shouldn't shave ever." writes one Mark Francis. Meanwhile, those who hailed the judgment, argued that homosexuality is a sin in all ramifications and should not be encouraged in the country. "Homosexuality is a sin in all ramifications whether religion or tradition. It should not be promoted because people consent to an irritating act." Rashida argues. Bukki said " we are Africans and we should not condone homosexuality. If the whole world is going mad, there must be a place where there is sanity.

And African is that place where we should preserve this." Chukwuemeka, was imprisoned for three months for for having sexual intercourse with another man through the anus. The convict, who resides at Gidan Mangoro, had pleaded guilty to having engaged in homosexual acts. "I am guilty of the charge against me. I was under the influence of alcohol and I want the court to temper justice with mercy", he said. The police prosecutor, Mohammed Umar, had told the court that the convict committed the offence in August when the complainant was sleeping in his bed. Homosexual acts, the prosecutor said, was contrary to Section 284 of the Penal Code. The prosecutor said since Mr. Chukwuemeka had pleaded guilty to the crime he initially denied, the court should try him summarily. The Senior Magistrate, Nafisatu Buba, sentenced him to three-month imprisonment without an option of fine.

 "This would serve as warning to other youths who hide under the influence of alcohol to commit crimes," she said. When he was first arraigned in early September, Mr. Chukwuemeka pleaded not guilty, saying, "I came back drunk from the night club and thought I was sleeping on the same bed with my girl-friend and I started romancing her." At that hearing, Mrs Buba, had ruled that alcohol should not be seen as an excuse for committing the offence, but then granted the accused bail in the sum of N200,000 with two sureties in like sum, with one of the sureties being a civil servant on Grade Level 09. However, when the case was heard Monday, the actor suddenly pleaded guilty, and Mrs Buba summarily tried him, sentencing him to three-month imprisonment. Homosexuality and lesbianism are seriously frowned at in Nigeria. In November, the Nigerian Senate passed a strict law banning same-sex marriage and public display of affection by gays in Nigeria. The bill - Same Sex Marriage (prohibition) bill 2011 - prescribes 14-year jail terms for convicted gays in Nigeria.
